TERMS AND CONDITIONS

This contract (“Contract”) is a distance contract pursuant to art. 50 and ss. Of the Legislative Decree 6 September 2005, n. 206 (“Consumer Code”). The Contract concerns the sale of movable property between Trevi Profumo S.r.l. with registered office in Via del Lavatore 57 – 00187 Rome (RM), registered in the Business Register of Rome n ° 1597480, VAT number 15533081004 and the consumer (the “Customer”).

The Contract is concluded directly through acceptance by Trevi Profumo S.r.l. by a purchase proposal issued by the Customer by telephone or via the Internet through the website www.treviprofumo.com (“Site”) and / or through other remote sales systems of Trevi Profumo Srl, on the basis of the methods described to the next article.

For any information regarding orders, shipments and, more generally, purchases, including the main characteristics of the products for sale on the Site, you can contact the customer service of Trevi Profumo S.r.l. at the following addresses:

 

GENERAL CONDITIONS OF SALE*

Art 1. – Acceptance of the general conditions of sale

The purchase of products for sale on this Site is reserved for individuals, natural persons of age, who act for purposes unrelated to any commercial, entrepreneurial, craft or professional activity carried out. Therefore, by sending an order (hereinafter the “Order”) in the manner provided on the Site and illustrated in the following art. 2, the subject (hereinafter “the Customer”) expressly declares to be of age and to act outside his own commercial, entrepreneurial, craft or professional activity.

By sending the Order, the Customer also declares to have read all the information provided to him during the purchase procedure and to fully accept these general conditions of sale (hereinafter the “Conditions”).

It is advisable to keep these Conditions which, for this purpose, can be printed or saved on a durable medium.

 

Art. 2. How to purchase / Conclusion of the contract:

Once the order has been confirmed, the customer will receive an e-mail message from treviprofumo.com confirming receipt of the order. A “Customer Order Number” will also be assigned which must be used in any communication with treviprofumo.com. Upon receipt of the order, treviprofumo.com will check the actual availability of the requested goods in stock. In the event of unavailability, even temporary, of the requested good, treviprofumo.com will contact you promptly and in any case within thirty (30) days by e-mail to decide how to fulfill the order.

Orders received on Friday, Saturday and Sunday will be processed starting from the following Monday.

 

Art. 3. Availability of products:

The customer can only purchase the products in the electronic catalog visible on the website www.treviprofumo.com in the quantities available in stock and possibly available from suppliers. The items selected from those present in the virtual catalog of the treviprofumo.com website can be purchased under the following conditions.

 

Art. 4. Shipping:

4.1 – After the conclusion of the order, Trevi Profumo S.r.l. will send the customer an e-mail confirming receipt of the order. The consumer is invited to print the e-mail and to keep it. Should the consumer not receive it, he is invited to contact Trevi Profumo S.r.l by e-mail; in the event of any impossibility, even temporary, to fulfill the order partially or totally, Trevi Profumo S.r.l. will promptly and in any case within thirty (30) days send an e-mail to make arrangements with the consumer, without prejudice to the possibility for the consumer to request cancellation, even partial, of the order.

 

4.2 – Trevi Profumo S.r.l. undertakes to ship the products to the address indicated by the Customer within 48-72 working hours from the conclusion of the order.

4.3 – For orders of alcoholic perfumery outside the territory of the European Union, Trevi Profumo S.r.l. undertakes to ship within fourteen (14) days.

4.4 – Trevi Profumo S.r.l. reserves the right to hold the shipment of products on hold or to cancel orders if the data provided during the purchase is not true (for example, email address or telephone number does not exist).

Art. 5. Prices

The sales prices of the products shown on the treviprofumo.com website include VAT and DO NOT include shipping costs.

Art. 6. Methods of purchase and payment

SECURE PAYMENT

The Customer will be allowed to choose one of the following secure payment methods:

 

  • PayPal SSL and all cards associated with it (VISA, MASTERCAD, AMERICAN EXPRESS, VISA ELECTRON, MAESTRO, AMERICAN EXPRESS, AURA, DISCOVER)
  • Credit card belonging to the VISA, MASTERCARD, AMERICAN EXPRESS circuits
  • Bank transfer * IN ADVANCE: in this case the order can be processed only after receiving confirmation of the credit from the bank
  • Online payment and in-store collection

* NOTE on ADVANCE BANK TRANSFER: The purpose of the bank transfer must include the order number as well as the name and surname of the Customer. It should be noted that the availability of the products will be assessable only at the time of accreditation. The Seller reserves the right to accept as proof of payment the transmission of the transfer coupon, received by email at info@treviprofumo.com. If we do not receive payment within 3 days of placing the order, the order will be deleted.

 

Art. 7. Obligations of the customer

The Customer declares and guarantees:

 

  • to be a consumer in accordance with the provisions of art. 3 of the Consumer Code
  • to be of age
  • that the data provided by the same for the execution of the Contract are correct and truthful

 

Art. 8. Right of Withdrawal

8.1 – The Customer has the right to withdraw from the stipulated contract, without specifying the reason, within fourteen (14) days of receipt of the products. The Customer may exercise the right of withdrawal within the aforementioned term, manifesting it by means of a registered letter with return receipt addressed to the headquarters of Trevi Profumo S.r.l. Via del Lavatore 57 – 00187 Rome (RM) or by PEC at the address treviprofumo@pec.it

 

8.2 – The Customer who intends to exercise the right of withdrawal must return the products perfectly intact and unused (still wrapped if received in this way) to the address indicated on the invoice / transport document within fourteen (14) days of receipt of the products.

 

The receipt attached to the shipment must be combined with the products to be returned.

 

Pursuant to Article 55, second paragraph, of the Consumer Code, the Customer will not have the right of withdrawal in the following cases:

 

Products used or damaged

Products opened by the Customer, therefore no longer intact

Supply of products made to measure or customized, or which by their very nature cannot be returned or are liable to deteriorate or expire rapidly (eg cosmetics).

8.3 – The costs of returning the products are charged to the customer. The customer must arrange the shipment with a shipping service of his choice. Trevi Profumo S.r.l. will return, within ten (10) days from the date of receipt of the products by the Customer, the full price paid by the Customer in case of return of the product complete with all its parts and features.

 

The money will be returned by bank transfer or alternatively through the channels used for payment when and if possible for the seller.

 

Art. 9. Right of replacement

In the event of replacement, the same rules as in point 8 “Right of withdrawal” apply. Trevi Profumo S.r.l. will verify the integrity of the returned product and the presence of the required documents, after which it will prepare the new package, subject to payment by the customer for the new shipment.

 

Art. 10. Storage costs

The customer is informed by email of the progress of the shipment. Specifically, it receives: dispatch e-mail and delivery day notification e-mail.

Our courier makes two attempts to pass: if at the first passage the customer is absent, the courier will come back the next working day, unless the delivery area is served by the courier every other day.

If the customer is absent even at the second passage, the package will go into storage in the warehouse closest to the delivery area. At this point the customer will have to personally take care of going to collect the package, paying the related storage costs that increase day by day and the amount of which is established independently by the offices themselves.

Trevi Profumo S.r.l. may decide, in the event of the customer’s failure to indicate, to release the stock by returning the package to the sender’s office. Trevi Profumo S.r.l. is required to return the amount previously paid to the customer, deducted from the costs of storage and return shipping (to be quantified on a case-by-case basis).

 

Major force

In any case of force majeure or unforeseeable circumstances, Trevi Profumo S.r.l. does not consider itself responsible for the delay or non-delivery and reserves the right to terminate the contract in whole or in part, suspend or postpone its execution.

 

Art. 11. Warranty

Product prices may be subject to updates. Please check the final sale price before submitting the related order form. You can request any information from the supplier through our assistance service.

On treviprofumo.com quality products are marketed and purchased directly from carefully selected producers and retailers. If the customer finds a defect in the products purchased, he can exercise the right of withdrawal. The consumer may request information, submit any complaints or communications deemed appropriate, in the following ways:

Trevi Profumo S.r.l guarantees the good quality of the products sold. During the warranty period, the Seller undertakes to promptly carry out at its own expense all the operations necessary to disassemble, repair, refit, those parts that prove to be defective due to poor quality of material or workmanship. Any obligation of the Seller for normal wear and tear, poor care, maneuvering error, overload, performance and stresses not falling within the limits specified in the user manual, recognized causes of force majeure, are excluded. The warranty period relating to the products will have a duration of 1 (one) years for B2B (Business To Business) contracts and 2 (two) years for B2C (Business To Consumer) contracts, unless otherwise specified at the time of purchase. These warranties do not apply to products not directly supplied or to products covered by the manufacturer’s direct warranty. For consumers (B2C), i.e. those who purchase for purposes unrelated to their professional or business activity, the supplier will apply the Legislative Decree 2 February 2002, n.24. – Articles 1519-bis and following of the Italian Civil Code – (two years from delivery under legal conditions); For other buyers (B2B), who usually purchase with a VAT number, the legal guarantees referred to in articles 1490 and following of the Italian Civil Code will apply. (one year from delivery under legal conditions).

 

Art. 12. Privacy

The personal data collected with the placing of the Order will be processed by Trevi Profumo S.r.l. for the sole purpose of satisfying the express requests of the Customer, in compliance with the reg. EU 679/16 and the privacy policy on the Site. Any further processing will be carried out only with the express consent of the Customer.

Purchase procedures and products

By registering on the treviprofumo.com site or in any case with the provision of their data for the execution of a sales order, the user expresses his consent to these General Conditions of sale (hereinafter the “General Conditions”) and to all the provisions governing the use of the site including, by way of example only, the General Terms and Conditions of use of the site and the Privacy Policy of the site, published on other pages of the site, which regulate registration, access, navigation and use of the site in general.

Before proceeding with the transmission of the order form, the customer will be able to identify and correct any data entry errors. Each order sent to Trevi Profumo S.r.l. by a customer constitutes the customer’s contractual proposal and, therefore, will be binding for the supplier only if, and when, confirmed by the same for acceptance. The seller will send the acceptance by e-mail after verifying the completeness and correctness of the order as well as the availability of the products ordered. The contract will be considered concluded when the final confirmation e-mail sent by the supplier has reached the e-mail server used by the customer. The order form contains a summary of the General Conditions of Sale, information on the essential characteristics of each product and the relative price (including all applicable taxes or duties), the means of payment that the customer can use to purchase each product and delivery methods of the purchased products, shipping and delivery costs. Before proceeding with the purchase of products, by sending the order form, the customer is required to carefully read the General Conditions of Sale, can print or store a copy of them for personal use.

The General Conditions are governed by the Legislative Decree 22 May 1999 n. 185 (hereinafter, the “Decree”) implementing directive 1997/7 / EC relating to the protection of consumers in respect of distance contracts and by Legislative Decree 9 April 2003, n. 70 implementing Directive 2000/31 / EC on certain legal aspects of information society services, with particular reference to electronic commerce. The General Conditions are available only in Italian.

The concluded contract will be filed through an electronic system and will be accessible to the staff of Trevi Profumo S.r.l. who needs to know it in relation to the execution of the contract, to any third parties that the seller uses for the execution of the contract and to the legitimate recipients in accordance with current legislation. By sending the order form to the supplier, the customer consents to the use of the telephone, e-mail and other automated call systems without the intervention of an operator in relation to the conclusion and execution of the contract. The seller may not process his purchase orders that do not give sufficient guarantees of solvency or that are incomplete or incorrect or in the event of unavailability of the products. In these cases, we will inform you by e-mail that the contract has not been concluded and that your purchase order has not been processed, specifying the reasons.

Trevi Profumo S.r.l. reserves the right to confirm or change the prices of the products published on its website or in information brochures and advertising material, upon confirmation of the customer’s order.

The technical and functional characteristics relating to the products published by the supplier through its promotional messages and information brochures are those communicated by the respective manufacturers. The supplier assumes no responsibility for the truthfulness and completeness of such information. The images of the products are indicative and not binding. All technical features and published prices are subject to change without notice.

The products are not provided on trial. The customer is responsible for the choice of the products ordered and for the correspondence and conformity of the specifications indicated by each manufacturer to their needs. If the products, presented on our site, are no longer available or on sale at the time of your last access to the site or when the purchase form is sent, it will be the supplier’s responsibility to communicate to the customer, promptly and in any case within thirty (30) days from the day following the one in which the order is sent, any unavailability of the products ordered. In case of advance payment, the supplier will refund the amount already paid.

 

SHIPPING INFORMATION

Packages are generally dispatched within one or two (1-2) working days of receipt of payment and are shipped via TNT, Bartolini, or Mail Boxes Etc.

As soon as your order is shipped, you will receive an email with the tracking link for the delivery status. The courier will deliver on average within 24/48 hours (excluding the weekend) from collection at our store.

Shipping costs include handling and packaging charges and postage. No additional handling costs are applied to shipping costs. Deliveries are made all over the world.

The delivery of international orders, outside the Italian state, depends on the courier and will be shared with the customer based on the individual specific order. Trevi Profumo srl is not responsible under any circumstances and under any circumstances for the modification of customs duties between Countries, or on specific products, or in any case indicated by law. Any additional costs incurred for changes in customs duties, or dependent on individual Countries, are charged to the customer. When ordering, Trevi Profumo will provide all available information necessary to ensure timely delivery.
